These Terms and Conditions ("Terms") govern your use of the website sydneymusicaltheatre.com.au (the "Website"), and your purchase of tickets or services from Sydney Musical Theatre PTY LTD ("we", "us", "our"). By accessing or using the Website, or purchasing a ticket from us, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Website or purchase tickets from us.

Sydney Musical Theatre is a musical theatre organisation based in Sydney, New South Wales, Australia. The Website provides information about our productions and events, allows visitors to sign up to our mailing list, and enables ticket purchases through our ticketing partner.

The Website includes a form allowing you to submit your email address to join our mailing list, managed through our email platform, Brevo. By submitting your email address, you consent to receiving marketing communications from us, in accordance with our Privacy Policy and the 'Spam Act 2003' (Cth). You may unsubscribe at any time using the link in any email we send you.

 

5. Ticketing

Tickets to our productions are sold through our third-party ticketing platform, currently Tixly. When you purchase a ticket, you will be directed to or use Tixly's platform to complete your booking, and Tixly's own terms of use and privacy policy will apply to that transaction in addition to these Terms.

- Ticket prices, availability, and any booking or transaction fees are set out at the time of booking and may change without notice.
- You are responsible for checking that your booking details (show, date, time, number of tickets) are correct before completing your purchase.
- Tickets are subject to availability and any conditions of entry specified for the relevant venue and production.

 

6. Payments

All payments made through the Website or our ticketing platform are processed by Stripe, our third-party payment processor. We do not receive, view, or store your card details. These are handled entirely by Stripe in accordance with its own security standards. By making a payment, you also agree to Stripe's applicable terms.

 

7. Refunds and Exchanges

Unless otherwise stated at the time of booking, or required by the Australian Consumer Law, tickets are generally non-refundable. Refunds or exchanges may be offered at our discretion in circumstances such as event cancellation, significant rescheduling, or venue changes. Where a production is cancelled or materially changed, we will contact ticket holders with information about refund or exchange options.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) that cannot lawfully be excluded.

 

8. Filming, Photography, and Recording at Events

Our rehearsals and performances may be photographed, filmed, or recorded by an authorised representatives or us for archival and promotional purposes. By attending one of our events, you acknowledge that you may appear in this footage or these images, which may be used on our website, in marketing materials, or on social media, in accordance with our Privacy Policy.

Where a performer is under 18, consent for filming and photography is obtained from a parent or guardian as part of the production enrolment process.

 

Audience members are not permitted to record or photograph performances themselves unless expressly permitted by venue conditions of entry or by us.

 

9. Child Safety

We take the safety of children involved in our productions seriously. All performers, staff, and volunteers working with children as part of our productions are required to hold a valid Working With Children Check, verified through the relevant guardianship authority, in accordance with our child protection policy. 10. Intellectual Property

All content on the Website, including text, graphics, logos, images, video, and design, is owned by or licensed to Sydney Musical Theatre and is protected by Australian and international copyright and other intellectual property laws, unless otherwise stated. You must not reproduce, republish, distribute, or otherwise use any content from the Website including recordings or photographs of our productions for commercial purposes without our prior written consent.

 

11. Third-Party Links and Services

The Website may contain links to, or integrate with, third-party services (including Stripe, Brevo, and social media platforms). These are provided for your convenience. Please review their own terms and policies.

 

12. Disclaimer

The Website and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied. While we make reasonable efforts to keep information on the Website (such as event dates, ticket details, and venue information) accurate and up to date, we do not warrant that the Website will be error-free, uninterrupted, or that all information is complete or current. 13. Limitation of Liability
